1. Parties
SELLER: Opiona, https://opiona.com operates through the website address below. (Hereinafter referred to as "Seller" or "Platform".)
BUYER: The person or organization placing the order. (Hereinafter referred to as "Buyer" or "Customer".)
2. Subject of Agreement
This agreement, within the framework of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regulates the rights and obligations of the parties regarding the sale and delivery of the product/service ordered by the Buyer electronically through the Opiona website.
3. Product/Service Subject to the Agreement
The Buyer has reviewed and accepted the products or services specified in the order form, their features and sale prices, prior to ordering.
- Product type, quantity, price and delivery information are shown on the order summary page.
- Digital products are delivered via download link or access through the platform.
- Physical products are shipped to the delivery address specified during the order.
4. Payment and Order
The order is finalized upon payment approval. The Buyer is deemed to have accepted this agreement at the moment they complete and confirm the order form.
5. Delivery
- Digital products: Instantly activated to the user account or a download link is sent via email upon payment approval.
- Physical products: Delivery is made within 30 (thirty) business days from order confirmation. Delivery time may vary depending on the product location and courier company.
In case of force majeure, stock shortage or extraordinary circumstances, the Seller notifies the Buyer about the delay. The Buyer has the right to cancel the order in such cases.
6. Right of Withdrawal
The Buyer has the right to withdraw from the agreement within 14 (fourteen) days from the date of delivery without giving any reason and without paying any penalty.
Products/services where the right of withdrawal cannot be used:
- Products that have been opened, used, worn or damaged after delivery.
- Digital content delivered electronically and used once (game codes, license keys, digital files, etc.).
- Personalized products prepared per the Buyer's specific request that cannot be returned.
- Products that may deteriorate quickly or whose expiry date may pass.
Notice of withdrawal must be sent to the Seller via our contact page or by email.
7. Returns and Exchanges
For return requests under the right of withdrawal or warranty, the product must be returned to the Seller in the same condition (original packaging, invoice and accessories included) and shipping costs are borne by the Buyer. After the return is accepted, the payment will be refunded via the same payment method within 14 business days.
8. Privacy and Personal Data
Personal data of the Buyer is processed in accordance with KVKK Law No. 6698 and our Privacy Policy . Data is not shared with third parties and is only used in the execution of order and delivery processes.
9. Dispute Resolution
In disputes arising from this agreement, the Buyer should first contact the Seller directly. For unresolved disputes, Consumer Arbitration Committees or Consumer Courts are authorized pursuant to Law No. 6502.
10. Entry into Force
This agreement enters into force upon the Buyer's confirmation of the order. The agreement is deemed to have been accepted electronically by both parties.
